Terms and Conditions

1 .Definitions In these Terms and Conditions.

Unless the context otherwise requires, the following expressions shall have the following meanings:

  • "Company" means Teddy Tastic Bear Co.
    "Customer" means the person, company, or organisation placing the order with the Company.
    "Products" means the goods supplied by the Company under these Terms and Conditions.

2. Orders and Specifications

2.1. All orders are subject to acceptance by the Company.

2.2. The Customer shall be responsible for ensuring the accuracy of the terms of any order.

2.3. The Company reserves the right to make changes in the specification of the Products required to conform with any applicable statutory or health and safety requirements.

3. Prices and Payment

3.1. The price of the Products shall be as stated in the Company’s price list, website or official quotation.

3.2. Prices are exclusive of VAT unless otherwise stated.

3.3. Payment is due in accordance with the terms agreed at the time of order.

3.4. The Company reserves the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate.

4. Delivery

4.1. Delivery dates are estimates and the Company shall not be liable for any delay in delivery.

4.2. Delivery shall be made to the address agreed at the time of order.

4.3. Risk of damage or loss of the Products shall pass to the Customer upon delivery.

5. Retention of Title

5.1. Title to the Products shall not pass to the Customer until the Company has received payment in full.

5.2. Until title passes, the Customer shall hold the Products as the Company’s fiduciary agent and bailee.

6. Warranties and Liability

6.1. The Company warrants that the Products will correspond with their specification and be free from defects in material and workmanship for a period of 6 months from delivery.

6.2. The above warranty is given by the Company subject to the following conditions:

6.2.1. The Company shall be under no liability in respect of any defect arising from fair wear and tear, negligence, or abnormal working conditions.

6.2.2. The Company shall be under no liability if the total price for the Products has not been paid by the due date.

6.3. The Company's liability shall not exceed the price of the Products and shall not include indirect or consequential loss.

7. Returns and Refunds

7.1. Products may only be returned with prior authorisation from the Company.

7.2. The Customer shall bear the cost of returning Products unless otherwise agreed.

7.3. Here at Teddy Tastic, we try our very best to ensure that our products are of the highest quality. However, if you are unhappy with your purchase you can send them back for a full refund within 28 days of purchase through your original payment method.

7.4. To obtain a refund it is essential that you follow the instructions below. These provisions apply in the event that you return goods to us because you say they are faulty:

7.4.1. All order discrepancies must be reported within 48 hours of receipt of goods so we can quickly rectify the situation.  Please complete the form below to report any faults or discrepancies please complete the form below.

7.4.2. When reporting your discrepancy you must send full details of what goods, any defect and when the good were purchased. Should we ask you for a photograph of the product this should be sent via email to info@teddy-tastic.co.uk. It is important that you report you request before returning any good to us as we may not be able to identify sufficient details to enable us to deal with your concerns.

7.5 If at any time you are requested to return product to us, please send the product to The Partyman Company Ltd, Teddy Tastic, Marsh Farm, Marsh Farm Road, South Woodham Ferrers, Essex, CM3 5WP. Please always ship via a courier. All relevant items should be returned in the original packaging with all component parts.

8. Force Majeure

The Company shall not be liable for any failure or delay in performance of its obligations caused by circumstances beyond its reasonable control.

9. General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
